Filing for a marriage license before divorce is final?

My fiancee and her soon-to-be ex have been separated for some time, and she and I have been together for a good while. We plan to marry, and her divorce is filed and she is awaiting finalization. For obvious romantic reasons and the practicality of adding her to my insurance, we want to get married as soon as possible. With most places wanting 30 days prior to the wedding date to process a license application, is there anything that would impair applying for the license before her divorce is final?Filing for a marriage license before divorce is final?
To apply for a marriage license, you need to prove the divorce with the divorce certificate (or decree)... so no, you can't apply until the divorce is final. Plus, usually when the divorce is granted, there is a 30+1 day period until the divorce is actually final. I wouldn't file for the license until the divorce is final for one major reason. Sometimes divorces can be dragged out. Sometimes courtdates and such can be reschedualed and marraige liscenses are only good for a limited amount of time. If you file for the license before the divorce is final you could have to refile. Its always better to wait til one thing is finished before starting another. Also on your marriage license you will have to list the date the divorce was final so you can't really get one until you know that date. good luck!
I agree, do not file for the license until the divorce is 100% final. No matter if its an uncontested divorce or not, things can always happen to slow things down. If you get your marriage license and the divorce is not final it will expire and be a waste of time.


Some states may not even allow you to get a license until the divorce is final. Best for all involved to wait until things are legal then move on.
NO you can not - you will have to wait for the final divorce papers. Technically until the final papers are signed and filed, you are still married to that person - and if you apply for another license and marry before that is done, its illegal and you can be jailed for bigamy.
I suppose it depends on what the judge says. Some, say one can't remarry for a certain length of time. Once I was told I couldn't remarry for 6 months. This blew me away, but they can do this.





I'm not sure this will be in her finalization or not. But if not, I don't see a problem with filing for a marriage license. Ask your local Court house

Have you heard her husband's side of the story I bet she is not the angel shemakes herself out to be.Date a yr or so before you make a mistake son.

adding to your insurance and practicalities is no good reason to get married so fast... i think something is wrong...





divorces cost money!! and a lot of heartbreak... do things PROPERLY!!
